Release Deed
Easement for Town Way
The parties to this Release Deed are the Portland Water District, a quasi- municipal corporation of with a place of business at 225 Douglass Street, Portland, Maine (“District”), and the Town of Standish, a municipal corporation with a place of business at _________________, Standish , Maine (“Grantee”).
WHEREAS, as set forth in the Notice of Condemnation dated February 26, 2008, and recorded at the Cumberland County Registry of Deeds in Book 25839, Page 308, the District acquired the interests of the heirs, legal representatives, devisees, assigns, trustees in bankruptcy, disseisors, creditors, lienors and grantees of the Proprietors of the Town of Pearsontown in and to certain land in the Town of Standish, County of Cumberland, and State of Maine, which taking was subject to any and all easement rights in the town way known as North East Road;
WHEREAS, the parties desire to confirm the remaining easement interest of Grantee in said town way;
NOW, THEREFORE, the District hereby releases to Grantee an EASEMENT in and to the land in the Town of Standish, County of Cumberland, and State of Maine identified as “ North East Road” on the “Plan of a Portion of the North East Road in the Town of Standish as Redefined by the Commissioners of Cumberland County” dated July 18, 1957 and recorded at said Registry in Plan Book 7, Page 31 (hereinafter the “Easement Area”).
The Grantee shall have the following permanent easement rights in the Easement Area described above:
1. All such rights as are necessary to utilize the Easement Area as a town way for highway purposes, as defined in 23 M.R.S.A § 3021; and
2. the right to enter the Easement Area at any and all times for such town way purposes Including the right in Grantee’s sole discretion to maintain and improve the same as set forth in said Section 3021.
The rights granted herein shall be exercised and used in such a manner as not to cause any damage or destruction of any nature whatsoever to or interruption of the use of the adjoining lands owned by the District.
The use granted hereby shall be limited exclusively to the purposes recited herein.
The District reserves the use and enjoyment of the Easement Area for any purpose that does not interfere with the use of the Easement Area by the Grantee for the purposes provided for herein.
In Witness whereof, the Portland Water District has caused this easement to be signed by Ronald Miller, its General Manager, the ___ day of ___, 2008.
